I described Public Charge rule in my very detailed post at my EB1A blog. USCIS requires to submit I-944 form, Declaration of Self-Sufficiency so they can evaluate your potential Inadmissibility on Public Charge Grounds. This major change is reflected also in our EB2 NIW DIY kit, actually all our products were updated too (NIW ebook, I-485 kit, ETA 9089). Here is what was changed and what’s new.
Even though the main change is related to I-485 Adjustment of Status application there were also other minor changes made in all DIY kits.
I-140 Updates
Let’s start with I-140 petition:
- I-140 form updated to the most current version
- ETA-9089 form updated to the most current version
I-485 Updates
More significant updates were done in I-485 petition:
- changes in the list of documents mentioned in I-485 petition letter – added form I-944 and supporting evidence, work statement
- I-485 form updated to the most current version
- new form I-944
- new evidence IRS Tax return transcript
- new evidence checking account statement
- new evidence credit report
- new evidence 1095C
- new evidence health coverage confirmation for the current year
- new evidence health plan description
- new evidence work statement
- I-131 form updated to the most current version
- I-765 form updated to the most current version
NIW E-book
I have added a new chapter about Public Charge Rule to the NIW e-book. I also fixed couple broken links leading to the official resources.

Thank you for share all this information with us. Im willing to buy the Kit I just need to know if is it useful to a EB2 NIW with no family included on petition? Im single and I`ll apply just for me.
Thank you so much, Cris
Cris says
PS. Do you have instructions into the kit about which certificates do I need to included? In case, I got my Master degree in USA but my bachelor I got foreign. Im confused if I need to proof both or just the Master degree from USA.
EB2 NIW team says
Hi Cris,
my husband had two degrees (Ms and PhD) and because he mentioned both in the petition he needed to show the proof, plus credential evaluation documents including authorized translations for foreign degrees (all of this shown in our DIY kit).
Please let me know in case of any other questions.

EB2 NIW team says
Hi Cris,
you simply don’t add any family member to the petition, that’s it. You are the main applicant and the officer checks if YOU satisfy the requirements, dependents doesn’t matter.

Hi,
I am very interested in your DIY KIT. I already bought the Ebook.
My concerns are just about my qualifications.
I have more than 15 years of experience in my area (Systems and Software Engineer in Brazil), but I just got an Associate’s in 2010 (Brazil in IT Management) and my Bachelor’s in 2018 (here in the US and actually right now I am on my F1-OPT visa).
Have you heard about cases like mine? What do you think?
I found a lawyer that I could be included to the Danashar’s precedent.
Anyway, let me know if you DIY has some templates or examples from IT area.
I appreciate your help!

Hi Jefferson,
thank you for purchasing our book!
Your chances at NIW category depends how do you satisfy 3 NIW requirements, established by Dhanasar. How can you show that what you do is in national interest? Do you have distinguished experts who will give strong testimonials confirming your main arguments? Do you have strong past track of achievements? Any significant awards? Patents? Review requests? What about your impact on the field? There are many levels on which you can build your case. I am not allowed to tell you your chances (because I am not a lawyer) but this might be a good idea to do right now. Google keyword phrase: “free niw evaluation” and let several of them evaluate your case. Even if they say no, it is still possible. Lawyers usually don’t want to take weaker cases but it doesn’t mean you will not be able to build a case now or later. Hopefully you will hear many YES and this would be great. You will have an idea whether you are strong case or not.
My husband’s case shown in the DIY kit is a physicist.
If you decide in the future you want to purchase our DIY kit please let me know ahead and I will tell you how to get a discount $10 (because you already purchased the book).
Hope it helps, let me know in case of any other questions.

Hi Veronica,
I got the NIW DIY kit from you which was helpful in putting my wife’s packet together for the NIW I-140 Original Submission. She got a response of NIW RFE and currently working on it. I will appreciate any help you can provide to get this done successfully, thanks.
EB2 NIW team says
Hi Olanrewaju,
I am sorry to hear your wife got RFE. Every RFE is different so it is hard to give you some practical advice. USCIS should tell you what they are missing so make sure you carefully read their letter, submit what they ask for and meet the deadline.
I am sorry again, hope you can make it!

Hello,
I am an international dentist (India), did a Master’s in Public Health in the USA, followed by a Master’s in Program Management (USA), and now doing a Doctorate of Dental Surgery (USA), all under an F-1 visa status.
1. Do you think there is a chance of getting EB2 NIW?
2. I also got an offer as an associate professor from the university I am studying. Is there any other category where I can file or asl university to file for a green card?
3. In both cases how long will be the processing time for GC?
EB2 NIW team says
Hi Anusha,
thank you for your comment!
1) too little information to evaluate your case, you might want to submit your credentials and achievements to several lawyers and let them evaluate (google the term “free niw evaluation”). Only lawyers are allowed to evaluate your case, I am not a lawyer
2) this could be a great chance to get a green card (saving thousands of dollars) – you need to ask them if they are willing to sponsor your green card and if they say yes, their lawyers will take care of it, plus employer pays the fees (their lawyer should also decide which category would be best in your case)
3) this might be a problem because of “priority dates” (citizens of India are usually backlogged) – EB1A category has shorter waiting times than EB2 NIW (check my other blog where I described EB1A criteria)

Estela says
Hi Veronika,
I came across your DIY kit and I’m really interested in purchasing it. I just had a few questions before.
1. Did you include your school transcripts? I did my B.A. and M.A. both in the U.S., but when I was doing my bachelors I didn’t have the best grades in some classes because of my mental health. I’m not sure if my grades would have an impact in USCIS’ decision over my case. My masters’ grades are quite fine, and in good standing.
2. Does your DIY kit contain your own case package as a sample and also templates that users can use to personalize their own case? for example a cover letter template, or template for the letters of recommendation that we can adapt?
3. Would only one expert opinion letter suffice for the case? I’ve seen that people recommend that the right amount of letters are between 4-8 total between recommenders and independent recommenders; but that at least half of letters should come from independent recommenders. However, I’ve seen that only one letter from an independent expert is required. I was wondering about this item because I was planning on purchasing this service from an external company and it’s expensive to one.
4. And speaking about independent recommenders, did you also hire a third party for this requirement? would you recommend it?
Thank you so much for your help!!
EB2 NIW team says
Hi Estela,
thank you for your interest!
1) Grades were part of my husband’s official degree document so we included this. I don’t think this had any impact on our case though. One of the requirements is having advanced degree, that’s it.
2) It is our case, but DIY kit includes also editable files.
3) That number (4-8 letters) is quite usual (average I would say), in the other hand I haven’t heard from anyone who would succeed with only one letter (which does not mean it is impossible).
4) We did not hire anyone. The letters should be genuine. I know it is hard to get to those experts. We also started from zero, did not know anyone in the USA (we just moved here). But we did this from the bottom, step by step. Through people we knew at work / university, getting one step higher to other people and so on. Those experts must be willing to look at your work (if they don’t know you) and explain why your work is in national interest. Hiring some third party – how do you know it will be genuine and serve the purpose you need? However, I cannot give you any advice, I am not a lawyer. That’s just our own experience and you must do your own decision what works best for you.
Let me know in case of any other questions.

Hi Veronica,
Your blog is so helpful and thank you for making this helpful page.
My case of EB2 NIW was approved by USCIS, and now I am trying to prepare my documents for the green card. My question is do I need to fill up all forms I am filling out for my kids as well including the I-485 form?
Thank you
Niguss
EB2 NIW team says
Hi Niguss,
thank you so much for your kind words! Congrats for your NIW approval!
Generally, all dependents have their own set of forms, but it depends on your situation too. For example, you might not need EAD (work permit) for kids etc. If you want to see example of complete I-485 petition, including dependent, check out our I-485 DIY kit.
Let me know in case of any questions.
