Thanks to your e-book and detailed guide, I was able to really do my EB2-NIW package without a lawyer and I got approved after 7 months from the date of filing.I only have a Master’s degree, with only 1 first authored paper and 1 second authored paper with few citations! The suggestions on the letters of recommendation and ETA forms really helped!
I was able to beautifully draft a request for NIW based on the Dhanasar case.
I also emphasized that I have met other regulatory requirements for the exceptional ability such as memberships and certifications. Even with no PhD, I was able to get approved.
My field is in Toxicology. I have a Master’s in Forensic Science, 6 certifications, 1 award/recognition in the field, plus the 2 papers I mentioned.
I argued that my field is important and applied to a lot of applications in prong 1. Then I expounded in prong 2 my qualifications and then justified in prong 3 that it would be detrimental to the country to require me a labor certification.

Thanks to your blog and materials in the kit, I prepared my application in about 6 months.
After filing, it took ~200 days to get the approval.
No RFE received.
These were my credentials at the time of the application :
I am a post doc in the cancer research field. I had 15 papers, 6 first name, 1 high profile journal. >300 citations. One national award. I collected 8 ref letters, 4 from my inner circle and 4 independent . I was a reviewer in two peer-review journals and I was a scientific member of two different scientific associations.

I just received REQUEST FOR EVIDENCE from USCIS.
Dis anybody receive this type of request or has experience on best approach to reply them.
Surprisingly one of their requests is that I should complete I-140 Part 6 (items 1-9). I do not think this section is required for NIW. However I did not write ‘n/a’ in section 1 of the section which I jest noticed was included in the sample sent by Veronika. Could this be the reason for asking me to fill in this section? But I also know someone who completed it with limited information and was approved. He completed section 1,2,3,4,6,7,8,9.d. of that part 6.

I am so sorry to hear this. It is hard to say why. But I have heard terrible stories even from lawyers that they received unreasonable and wrong RFEs – for the things which were included in their petition and officers were requesting them. Or another story about RFE which requested missing things for regular EB2 but not necessary for NIW. I am not saying this is your case but keep this in mind too. I hope you can deliver what they want and receive your approval then. I wish you all the best!

Hi Veronica, I am from India (working in US since 2007 November) with a prior employer filed EB2 and have approved I-140 and PD is July 13, 2020. I could not file for I-485 as it so far has not become current. Now that I changed jobs, I intend to apply for EB2NIW. I think my my new EB2NIW still gets counted towards the per country quota limits(India). That said what benefits do I have going for EB2NIW. the 2 specific questions are
1. Do I become independent from the employer with an approved I-140 under EB2NIW?, so I no longer need the new employers for filing an H1B visa transfer? 2. Can I keep working with an EB2NIW in hand as it does not have any expiry date (so assuming it does not require me to renew anything, as I became independent of the employer, so no H1B to renew), so can I travel International under this situation? 3. In this scenario, I am working on my own(with Approved I-140 under EB2NIW) what would become the process for I-485 filing? your guidance and clarifications are much appreciated…

disclosure: I am not lawyer and this is NOT a legal advice, just general info. You need to adjust to your own situation and make your own decision.
EB2 NIW application is not tied to one employer so applicant can work anywhere he wants AFTER he has valid EAD approved or I-485 approved. I-140 itself is great first step but it is NOT work permit. Having I-140 approved means to have earlier priority date so you already are standing in the long line instead of joining later. Once PD becomes current for certain country applicant can file I-485 together with EAD (work permit) and I-131 (travel document). When those are approved applicant have permission to work anywhere or travel.

I have expired F1 status since November 2017. I reapply asylum october 2018. I don’t have second interview with asylum officer since october 2018.
Can I adjust my status with out leaving USA ?
some lawyers say we can try because you don’t have yet asylum interview. Some lawyers say you need to leave USA to adjust status?
Noone can give definite answer.
